1. About the Site

The Site exists to introduce real estate agents to Waypoint Noven, share information about how the brokerage operates, and let agents request a confidential conversation about whether Waypoint Noven is the right fit for them.

The Site is informational. Nothing on it is an offer of employment, an offer of representation, or a binding agreement. Any offer to join Waypoint Noven would happen separately, in a written Independent Contractor Agreement signed by both parties.

2. Calculator disclaimer

The income calculator on this Site produces illustrative estimates based on the numbers you enter and Waypoint Noven's current splits and fees structure. The numbers it generates are not:

• A guarantee of earnings
• An offer of compensation
• A representation that any particular agent has earned, will earn, or could earn the displayed amounts
• Tax, legal, or financial advice

Splits, fees, programs, and benefits are subject to change at any time. Past production by other agents does not predict your results.

3. Use of the Site

You agree not to:

• Use the Site for any unlawful purpose
• Interfere with or disrupt the Site, its servers, or networks
• Attempt to access non-public areas of the Site
• Submit false, misleading, or impersonated information through the forms
• Use any automated system (bots, scrapers) to access the Site without our written permission

4. Intellectual property

The Site, its content, branding, and design are owned by Waypoint Noven, LLC or our licensors and are protected by copyright and trademark laws. The names "Waypoint Noven," "Growth Shares," and "Navigator's Club" identify Waypoint Noven's programs and may not be used without our written permission. Nothing on the Site grants you a license to copy, modify, or redistribute our content.

5. Forms and submissions

When you submit information through the book-a-call form, the calculator form, or any other interactive feature on the Site, you confirm that the information you provide is accurate to the best of your knowledge and that you have the right to share it.

6. Third-party links

The Site may include links to third-party websites or services. We don't control those services and aren't responsible for their content, privacy practices, or business practices.

7. Disclaimer of warranties

The Site is provided "as is." We make no warranties, express or implied, about the Site's accuracy, completeness, availability, or fitness for any particular purpose. To the maximum extent permitted by law, we disclaim all such warranties.

8. Limitation of liability

To the maximum extent permitted by law, Waypoint Noven, LLC and its principals, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site, including (without limitation) any reliance on the income calculator's estimates.

9. Indemnification

You agree to defend and indemnify Waypoint Noven, LLC against any claims, damages, or expenses arising out of your use of the Site or breach of these Terms.

10. Governing law

Waypoint Noven, LLC operates as a licensed brokerage in the State of New Mexico and the State of Utah. These Terms, and any dispute arising out of these Terms or your use of the Site, are governed by the laws of the State of New Mexico and the State of Utah, in each case without regard to conflict-of-law principles.

Any dispute arising out of these Terms or your use of the Site may be brought in the state or federal courts located in New Mexico or Utah, depending on the nature and location of the dispute. By using the Site, you consent to the personal jurisdiction of those courts.

11. Changes to these Terms

We may update these Terms from time to time. The effective date at the top reflects the most recent change. Continued use of the Site after a change means you accept the updated Terms.
